Lavelle Industries, Inc., and its affiliated entities (hereinafter, collectively, “Company,” “we,” “us,” or “our”) has created this Privacy Statement (this “Privacy Statement”) for the users of our website and to demonstrate our firm commitment to your privacy. This Privacy Statement describes how the Company collects, uses, and discloses your personal information both online through our websites that link to this Privacy Statement (collectively, the “Company Sites”) or offline when you otherwise communicate with us.

We may collect, among other things, your IP address, location, device type, date and time of visit, operating system, browser type and version, activities on the Company Sites, and information about how you use the Company Sites. For example, our web server automatically logs which pages of the Company Sites our visitors view, their IP addresses, and which web browsers our visitors use. For example, we use third parties to provide our search bar functionality on the Company Sites.

We may also disclose your personal information as you direct us to or where you have consented to such disclosure. We may create, use, and disclose aggregated or de-identified information about our users, and information that does not personally identify any individual, without restriction. We may disclose, and have disclosed in the past twelve (12) months, personal information to the following third parties: (i) our subsidiaries and affiliates; (ii) a buyer or other successor, including a potential buyer or successor in any proposed sale, assignment, merger, amalgamation, plan of arrangement, or other transfer of our business; (iii) our third-party service providers; (iv) our analytics providers; (v) our marketing partners; (vi) our distributors; and (vii) legal or regulatory authorities and other relevant third parties for legal reasons. Further, where you have consented, we may also disclose your personal information with other companies within our group of companies or disclose your personal information to other businesses who may contact you about their products or services that may interest you.

In addition, we may also disclose to third parties aggregated or other information that does not identify you individually, such as how many customers viewed a particular product or web page. We may disclose this aggregated information for any legal purpose. For example, we may disclose aggregated user statistics in order to describe our products and services to current and prospective business partners and to other third parties for other lawful purposes.

We do not sell or share (for cross-context behavioral advertising) and have not sold or shared (for cross-context behavioral advertising) personal information in the twelve (12) months preceding the Effective Date of this Privacy Statement.

You may have certain rights relating to your personal information subject to local data protection laws. Depending on the applicable laws and in certain circumstances, you may have the following rights:

  • Right to Request Deletion: You may have the right to request that the Company delete any of your personal information that we collected from you and retained, subject to certain exceptions.
  • The Right to Correct: You may have the right to correct inaccurate personal information that we maintain about you.
  • The Right to Non-Discrimination: You may have the right not to receive discriminatory treatment for exercising these rights.
  • The Right to Appeal: You may have the right to appeal a decision we may make related to your request. To the extent you have a right to appeal a decision we’ve made about your personal information, please submit an appeal request to us via Customer@lavelle.com .
  • “Shine the Light”: California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information to a third party for the third party's direct marketing purposes.

Exercising Your Rights

To exercise your rights described above, please submit a verifiable consumer request to us by:

Only you, or a person that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. If you are making a request on behalf of another person, you must provide written legal documentation that you are authorized to act on behalf of that individual. The verifiable consumer request must:

  • Provide sufficient information that allows the Company to reasonably verify you are the person about whom it collected personal information or an authorized representative thereof; and
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We may not be able to fulfill your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. To verify your identity, we may request up to three pieces of personal information about you, and we reserve the right to take additional steps as necessary to verify your identity if we have reason to believe a request is fraudulent.

Response Timing and Format

The Company endeavors to respond to a verifiable consumer request within forty-five (45) days of its receipt. If the Company requires more time (up to ninety (90) days), it will inform you of the reason and extension period in writing. The Company will deliver the written response by mail or electronically, at your option. The response the Company provides will also explain the reasons it cannot comply with a request, if applicable. For data portability requests, the Company will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

The Company Sites may contain hyperlinks to websites that are not operated by us. These hyperlinks are provided for your reference and convenience only and do not imply any endorsement of the activities of these third-party websites or any association with their operators. We do not control these websites and are not responsible for their data or privacy practices. We urge you to review any privacy policy posted on any website you visit before using the website or providing any personal information about yourself.

Protecting the privacy of children is especially important. Our Company Sites are not designed to attract or interact with children eighteen (18) years and under. We do not collect information from those we know are under eighteen (18).

However, you should be aware that there is always some risk involved in transmitting information over the Internet as no method of transmission over the Internet or method of electronic storage is 100% secure. While we continually strive to protect your information, we cannot ensure or warrant the security and privacy of any information you transmit to us. Transmission of information to us is at your own risk.

We strive to retain your personal information for no longer than is necessary for the purpose stated in this Privacy Statement, unless otherwise extending the retention period is required or permitted by law. The data storage period may vary with scenario. The standards we use to determine the retention period are as follows: the time required to retain personal information to fulfill business purposes, including providing products and services; maintaining business records; controlling and improving the performance and quality of the Company Sites; handling possible queries or conducting assessments of complaints; whether you agree to a longer retention period; and whether the laws, contracts, and other equivalencies have special requirements for data retention.
